     3   MR. MORRIS:  Can I bring up a couple of legal points?

     5   MR. JUSTICE BELL:  Yes, do.

     7   MR. MORRIS:  Just to inform the court that I have been
     8        contacting all our employment witnesses.

    10   MR. JUSTICE BELL:  Yes.

    12   MR. MORRIS:  Some are difficult to get hold of, but the ones
    13        that have been confirmed are ----

    15   MR. JUSTICE BELL:  These are additional to the ones you have
    16        mentioned in the past?

    18   MR. MORRIS:  Yes.  They are Melanie O'Riordan; I think it is
    19        Andrew Brett, he is a Colchester person; Kevin Harrison, he
    20        is a partner of Kate Harrison; Dave Turnbull from the
    21        Transport & General Workers Union; and Andrew Cranner, who
    22        is an ex-manager from Ealing.  I was also going to say that
    23        we are not going to be calling Kate Pearson, who was the
    24        overtime tribunal person.

    26        The other thing is, can we ask for Ms. Hovi to be released,
    27        because the deadline has passed for McDonald's to serve
    28        their rebuttal statements; and, also, there may be argument
    29        about that later.  But, in any event, in the circumstances,
    30        we feel she should be released.  It is not fair to her.

    32   MR. RAMPTON:  My Lord, as to that last point, the final draft
    33        statement, which is about 25 pages long, is with Jarretts
    34        at the moment.  We expect to get it back tonight.  Sorry
    35        that it has taken so long; it has been a very detailed
    36        exercise.

    38   MR. JUSTICE BELL:  As I understood it, you thought Mr. Purslow
    39        would be relatively short, in chief?

    41   MR. RAMPTON:  Yes, he will.

    43   MR. JUSTICE BELL:  On that basis, when do you think we are
    44        likely to finish Mr. Purslow?

    46   MR. MORRIS:  We are not expecting his cross-examination to take
    47        more than two days.

    49   MR. JUSTICE BELL:  What I would like to do, on the basis that by
    50        Wednesday morning your statement should have been 
    51        served ----

    53   MR. RAMPTON:  Yes.  I sincerely hope it will be.  I am conscious
    54        -- I do not agree with Mr. Morris' expression "deadline",
    55        because your Lordship did not do more than say ----

    57   MR. JUSTICE BELL:  I did not impose a deadline, but I am
    58        extremely anxious that Ms. Hovi should know where she
    59        stands as soon as possible.
