Day 131 - 06 Jun 95 - Page 02
Tuesday, 6th June 1995.

MR. MORRIS: Can I bring up a couple of legal points?

MR. JUSTICE BELL: Yes, do.

MR. MORRIS: Just to inform the court that I have been
contacting all our employment witnesses.

MR. JUSTICE BELL: Yes.

MR. MORRIS: Some are difficult to get hold of, but the ones
that have been confirmed are ----

MR. JUSTICE BELL: These are additional to the ones you have
mentioned in the past?

MR. MORRIS: Yes. They are Melanie O'Riordan; I think it is
Andrew Brett, he is a Colchester person; Kevin Harrison, he
is a partner of Kate Harrison; Dave Turnbull from the
Transport & General Workers Union; and Andrew Cranner, who
is an ex-manager from Ealing. I was also going to say that
we are not going to be calling Kate Pearson, who was the
overtime tribunal person.

The other thing is, can we ask for Ms. Hovi to be released,
because the deadline has passed for McDonald's to serve
their rebuttal statements; and, also, there may be argument
about that later. But, in any event, in the circumstances,
we feel she should be released. It is not fair to her.

MR. RAMPTON: My Lord, as to that last point, the final draft
statement, which is about 25 pages long, is with Jarretts
at the moment. We expect to get it back tonight. Sorry
that it has taken so long; it has been a very detailed
exercise.

MR. JUSTICE BELL: As I understood it, you thought Mr. Purslow
would be relatively short, in chief?

MR. RAMPTON: Yes, he will.

MR. JUSTICE BELL: On that basis, when do you think we are
likely to finish Mr. Purslow?

MR. MORRIS: We are not expecting his cross-examination to take
more than two days.

MR. JUSTICE BELL: What I would like to do, on the basis that by
Wednesday morning your statement should have been
served ----

MR. RAMPTON: Yes. I sincerely hope it will be. I am conscious
-- I do not agree with Mr. Morris' expression "deadline",
because your Lordship did not do more than say ----

MR. JUSTICE BELL: I did not impose a deadline, but I am
extremely anxious that Ms. Hovi should know where she
stands as soon as possible.
