Day 046 - 04 Nov 94 - Page 16

       A. Similar to what you might have here?

  Q. Yes.
       A. No, but they are very careful. Obviously, they have
their own image and concerns to keep in the public's eye.

  Q. Do the Attorneys General have any involvement in television
       advertising?
       A. Not directly, from the perspective of working with the
       networks or-----

  Q. Monitoring or controlling, or----
       A. I am sure they do it within the common sense of the
good use of advertising, and so forth, but they do not have
a direct role that I know of, other than their own
regulations that they enforce; overall regulations, I am
sure, from the Federal Trade Commission on advertising or
deceptive advertising, from the perspective of how they
look at it, but it really does not specifically apply to
how the networks look at it. I am sure that, in making
their own regulations, they take into account any other
regulations that are mandated by governmental bodies.

MR. JUSTICE BELL: Presumably, it is the same with any other
industry which regulates itself: it has to take a bit of
care in order to avoid regulation being taken away from the
industry and put in some statutory body beyond its control?
       A. That is correct. There used to be----

  Q. To what extent it is successful in doing that might be a
matter for argument in any particular case. But that
       ultimate sanction?
       A. Yes. If they are not able to control their own
       industry.

  Q. Or if it is thought they were not controlling it in a way
which was in the public interest?
       A. That is correct.

MR. MORRIS: Apart from commercial considerations from the
networks and your own code, you have said in your -- it is
in the European Golden Arches code, but I think I have seen
it somewhere in the US one, as well -- "We abhor
censorship." What do you mean by that?
       A. I am not sure what you are referring to.

MR. MORRIS: In the Golden Arches Code. I am trying to find
the US rather, than the European one.

MR. JUSTICE BELL: Which bundle are you in, for a start?

  MS. STEEL: Pink VII.

MR. MORRIS: It is just a phrase on page 118 of that: "Policy
       toward the television environment."
       A. What section had?

MR. JUSTICE BELL: It is section 7, page 118. It is the
       1987 Golden Arches Code.
