Day 172 - 12 Oct 95 - Page 16

MR. RAMPTON: My Lord, I do not know whether your Lordship wants
me to say anything about that now?

MR. JUSTICE BELL: No, not at the moment.

MR. RAMPTON: I will have something to say.

MR. JUSTICE BELL: As I said before, the mere fact that I put
new statements in the bundle does not mean to say that
I will give leave for the witnesses to be called. Even if
the parties are agreed, I may say no, it is too late.
But I will have to rule on that at some stage; and if there
is a difference between the parties as to the matter I will
       hear argument before I rule.

MR. MORRIS: I think the last thing that I have got is, I have
got a better copy of Keith Baker's statement, which
I believe was one of the ones which you said you could not
       read.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: A copy of the original is actually quite -- you
could not read it because of the handwriting. (Handed) If
that is readable now, then that will save having to type it
       out, but otherwise -----

MR. JUSTICE BELL: I can read that.

MR. MORRIS: Thank you. I think there is one more point. I am
       not sure.

MS. STEEL: Unfortunately, I have not brought my note with me,
but when I was looking through the things from
Mr. Fairgrieve at the weekend, I am pretty sure the survey
that has been disclosed is not the right one, the questions
for the first survey, the Taylor Nelson one, because
Mr. Fairgrieve said in his evidence that it was done over
the telephone and the survey was all about showing people
cards and things like that; and I could not get the
questions to tally up with the results in the charts. So
I do not know whether this was something that ought to be
       looked into before -----

MR. JUSTICE BELL: What I suggest you do -- I mean,
Mr. Fairgrieve has gone off again and it is not suggested
he be called in the immediate future at the moment.
I think you should write a letter to Barlow's saying just
why you think you have not got what you want. Then they
can consider that. I will deal with it if I can be of any
assistance one way or the other.

MS. STEEL: Right. Well, it is the Taylor Nelson one.

MR. JUSTICE BELL: Put it in a letter.

MR. JUSTICE BELL: Apart from anything else, if you have your
notes about it at home, you will probably be able to make
your position much clearer if you write it down.
