Day 168 - 03 Oct 95 - Page 16

false impression, that the fact of a complaint proves
anything relevant to the truth or otherwise of this
       leaflet.

MR. MORRIS: Right. We will hold our fire on calling for the
witness until we see the discovery that will be ordered.

MR. JUSTICE BELL: Carry on now, but bear that in mind.

MR. MORRIS (To the witness): So, likewise, any evidence that
may have been given about the lack of complaints would also
       be of no relevance.

MR. JUSTICE BELL: It is not going to decide my mind one way or
       another, Mr. Morris.

MR. MORRIS: Right. We do not have to deal with that then. (To
the witness): Phil Pearson was an Area Supervisor, was he?
       A. Paul Pearson was.

  Q. Sorry, Paul Pearson?
       A. Paul Pearson was, yes.

  Q. When he had Managers' meetings he took notes in a book, did
       he?
       A. Occasionally he did and occasionally he did not, but he
was not present at all of our Managers' meetings because he
       was the Area Supervisor.

MR. JUSTICE BELL: Can I have some idea of his dates as Area
Supervisor, if you can give them?
       A. He was the Area Supervisor from -- I do not know the
date exactly when he started. I would assume it is 1989, I
would say 1989, until about May of this year, and he has
since moved to the Training Department at Finchley.

MR. MORRIS: When he was present though he had a book in which
he made notes about matters that came up at the Managers'
       meeting?
       A. He may well have done but I think they were sort of
personal notes rather than actual minutes of meetings.

  Q. So he made what seemed to be personal notes then?
       A. Presumably, yes, but .....

MR. JUSTICE BELL: Do you know whether he had a book?
       A. We have a book in the restaurant now which the Company
have recently introduced where we record our Managers'
meetings in it for our reference.

  Q. When did that come about?
       A. I assume that has been in -- that has been since Phil
has been here -- six, eight months. I do not know the
       exact date.

  Q. You were being asked about the Area Supervisor having a
       book?
       A. He has not got a specific book in which he records
minutes of meetings in because he is not present at all of
our meetings. I would say he was present at maybe one in
