Day 120 - 03 May 95 - Page 35

MR. MORRIS: How many restaurants does McDonald's have round the
       world -- 15,000?
       A. I am not sure, I think about 15,000.

  Q. And 10,000 in America, yes?
       A. Yes, something like that.

  Q. Of that 10,000, in America, how many are franchised? I am
       sure you know that?
       A. I do not. About 8,000, I think.

  Q. About 8,000 -- exactly?
       A. No, not exactly.

  Q. What I mean is of your 10,000 restaurants in America 8,000
       are franchised?
       A. Yes.

  Q. Of your, whatever number of restaurants were or are in
       Ireland ---
       A. All of them are franchised.

  Q. All of them are franchised?
       A. Yes.

  Q. But they are your restaurants.

MR. JUSTICE BELL: I am sorry?
       A. No.

MR. JUSTICE BELL: Maybe I just cannot put aside being a lawyer,
it may well be at the end of the day that you will be able
to point to evidence which says, although this employee
McCann and this employee O'Brien, had their contracts of
service with Pantry Franchise Ireland Limited, which is not
       a McDonald's company, but a company with whom McDonald's
Corporation, or a McDonald's company, had some contractual
relationship, then by reason of instructions they have
given, or terms of their franchise arrangement, or
something like that, they had control or influence over the
way employees were treated. But at the moment the evidence
of this witness is that the contractual relationship
between a franchisee and a crew member was for the
       franchisee and the crew member.

MR. MORRIS: To be honest, the stores in Ireland have an "M" on
them. They are called McDonald's, and they were called
       McDonald's at that time?
       A. Yes.

  Q. They were not called Pantry Franchise?
       A. The own was Pantry Franchise Limited.

  Q. But the reality is they were a McDonald's store, and
McDonald's is responsible for the products they serve?
       A. Yes.

  Q. Their advertising -- I do not mean they control everything,
but they are responsible. If that store does something
