Day 120 - 03 May 95 - Page 28

  Q. And so on?
       A. Yes.

  Q. And you had made it clear ---
       A. Perfectly clear, my Lord, that he would be there and
I wanted to know when he left.

  Q. -- that he could not for union purposes go into the
       restaurant ---
       A. That is right.

  Q. -- and then you ask the Manager to let you know what
       happened, I assume?
       A. That is right, yes, simple.

  Q. I assumed that was because you were interested in how far
       at all Mr. Pearson's ---
       A. I just wanted to know.

  Q. -- aim to get crew members as members of his union got, if
       it got anywhere at all?
       A. Well, yes.

  Q. That is what was happening?
       A. Yes. I just wanted to know what happened, as I had
given permission, and I could not deny the permission for
him to stand outside of our restaurant, as I had agreed
that he could but had laid a restriction on him that he
could not go inside and distribute, I rang the Manager. He
could not go inside and distribute the literate. I rung
the Manager and told him what I had said and asked for him
to ring me back with what occurred.

MS. STEEL: So, you were concerned about whether or not he had
       any success?
       A. No. I just wanted to know when it was finished.

  Q. Did you ask the Manager about which staff had taken
leaflets or shown an interest? Is that part of the report?
       A. I think he told me. No, he told me that some of our
customers had picked them up. I cannot remember whether he
mentioned whether staff had or not. He certainly said the
       customers had been handed leaflets.

MR. MORRIS: Ms. Steel asked you whether you were concerned
about whether or not he had any success in his leafleting,
and you said: "No, I just wanted to know when it was
finished". So you were not concerned whether the staff
responding either positively or negatively; is that
       correct?
       A. I certainly was not overly concerned.

  Q. But if staff had been enthusiastic in their response, that
       would have concerned you?
       A. They obviously were not because the Manager would have
told me, and he did not

MR. JUSTICE BELL: Leave it there. At the end of the day you
are going to say that Mr. Nicholson was concerned. It is
having asked the question and got the answer, as a matter
