Day 120 - 03 May 95 - Page 27

call your own witnesses but it is not now or never.

MR. MORRIS: Yes. If it is any help, we are pretty confident
that we will definitely be finished by the end of this
       week.

MR. JUSTICE BELL: Yes. Keep going. Sit down and see where you
       are now. (Pause)

MR. MORRIS: Sorry, we are just trying to sort out what to do.
Maybe if we go on to something completely different for a
       while?

MS. STEEL: You said in your evidence-in-chief about Philip
Pearson. You said he rang you in the morning and said he
wanted to distribute literature to the crew members at
Warren Street. You said he could distribute outside the
store. You said, as you understand it, he was there for
about an hour; is that right, yes?
       A. That was my understanding, according to the Restaurant
       Manager.

  Q. How did you know that he was there for about an hour?
       A. The Restaurant Manager phoned me and told me he had
       left.

  Q. Did you ask the Restaurant Manager for a report on what is
       going on?
       A. Oh, yes, I did -- verbally.

  Q. A verbal report.
       A. Yes, I did.

  Q. Why did you ask the Restaurant Manager for a report?
       A. Because I wanted to know.

  Q. Why should it worry you if a member of a union is handing
       out leaflets to crew members?
       A. It did not worry me. It did not worry me.

  Q. If it did not worry you, why should you want to know?
       A. Of course I want to know. I want to know everything
that happens at a store. I want to know when members of
London Greenpeace stand outside of a store and distribute
literature and I want to know when they leave.

  Q. Do you receive reports of every single occasion when any
single leaflet gets handed out outside a store?
       A. It is very difficult because -----

MR. JUSTICE BELL: You had specifically ask to be told?
       A. Yes.

  Q. Presumably, you would ask the Manager that after
Mr. Pearson had rung you up ---
       A. Yes.

  Q. -- to enquire about speaking to crew members?
       A. Of course, yes.
