Day 055 - 25 Nov 94 - Page 34

mind made by Mr. Miles, which you would like Ms. Dibb to
       answer, if she can.

MR. RAMPTON: My Lord, might I add to that that there is not
very far that that line of question can go; it might only
be one question, I suspect; and that after that, with your
Lordship's approval, we should break off, because to make
five or six copies of a 20 page document takes a bit of
time. Then we could all get it at least in time for
       two o'clock.

MR. JUSTICE BELL: Yes. That recommends itself to me. You can
actually have a look, as well. But what is the point of
interpretation which Mr. Miles made? I know I made one,
which was in relation to where concern came from and
strength of concern, and whether there was any qualitative
(as opposed to quantitative) question. Maybe Ms. Dibb will
deal with that, or maybe when we actually look at the
survey we will find what the answer is to that. But what
is the point which Mr. Miles made that you have in mind at
       this moment?

MR. MORRIS: On question 1, there was a particular point.
I cannot remember whether it was yourself or Mr. Miles.

MR. JUSTICE BELL: No. It was Mr. Miles who said he thought
"tougher restrictions" meant tougher than in relation to
advertising to adults, rather than tougher than they are at
       the moment.

  MR. MORRIS: Right -----

MR. JUSTICE BELL: If my memory serves me correctly.

MR. MORRIS: Yes. (To the witness) These are the actual
questions in the survey, are they not -- in your summary?
       A. Yes.

MR. MORRIS: What does question 1 mean to you?

MR. RAMPTON: Well, I do not know what I am being asked to say.

MR. JUSTICE BELL: I am going to stop it there. We will break
off now. We will get copies of this because, in the
survey, there is, presumably, a paragraph or two -- maybe
more -- which deals with this question and MORI's
interpretation of the answers to it. (To the witness) Is
       that right?
       A. I can report on that, yes.

  Q. Since MORI have reported on it, we had better see what they
       said.
       A. Yes. But I have additional information.

MR. JUSTICE BELL: I think we should do that. It is a very
indirect way to just have one person in court with the
actual document, giving her interpretation of it. No
disrespect to you, but there are better ways of doing
       things.
