Day 055 - 25 Nov 94 - Page 26
should pay responsible regard to health implications?
A. Yes, there are; and I am pleased that the ITC has
recognised that.

Q. What would you say is the organisation in this country that
has done the most to argue and lobby for that recognition?
A. In relation to advertising?

Q. Yes.
A. I think it would have to be said that the National Food
Alliance has played an important role, particularly within
the context of the Nutrition Task Force and the
Government's Health of the Nation.

Q. At the bottom of the page, that paragraph talks about, as
far as I understand it, two main positions. If you just
read it to yourself. (Pause) Just that paragraph, would
you say that that is a fairly accurate summary of the -----

MR. JUSTICE BELL: The two positions.

MR. MORRIS: The two main positions in the debate that is going
on?
A. I think it is a summary of the public health interest
position and the industry position. I, personally, feel
unhappy about both of these being presented as with an
apparent equal weight. I think the motives of the
different interests and positions as expressed here are
quite different; and that whilst I agree they broadly
reflect the different positions, I think their
juxtaposition in this context, I feel, is unfortunate.
I would also -----

Q. So you do not believe the two positions should be given
equal weight where public health is concerned?
A. Yes. I believe that public health should be given
priority.

Q. Mr. Miles put himself squarely in the second position. It
may be not necessary to ask you but, presumably, you put
yourself squarely in the first position?
A. Yes, I do. I have to point out, though, that this is
only part of the submission which I would associate myself
with, and it is only referring to the part which the ITC
has decided that it is not going to address at this stage.

I just want to refer to the letter which was sent to me by
Frank Willis at the same time as I received these
consultation documents.

MR. JUSTICE BELL: Has Mr. Rampton had this?

MS. STEEL: I am not sure.

THE WITNESS: I think I have only got it. I just wanted to
read out one sentence, but I am happy for it to be
available.

MR. JUSTICE BELL: Can it be handed down, and let Mr. Rampton
read it first.
