Day 055 - 25 Nov 94 - Page 10
leading question -- would it not be that they are
recognising there are concerns about nutritional balanced
meals and children getting ----
A. This concern about snacking, yes, and part of that
would be a nutritional concern.

MR. MORRIS: So what is the overall underlying spirit of many of
these points that we have looked at?

MR. JUSTICE BELL: What is the point of that question, exactly?

MR. MORRIS: Would you say there is a recognition of public
concerns?
A. There is a recognition that children are a group which
advertising must pay particular care and due regard to.

MR. JUSTICE BELL: You are either attacking the ITC or not. It
is a bit difficult to be attacking it -- it may be
justified attack -- it one in breath and then say:
"Because the ITC has a concern for children, it just shows
that is important."

MR. MORRIS: It may be that they are recognising that there are
concerns, but they do not do their job properly.

MR. JUSTICE BELL: Maybe. Obviously, there should be concern
for children in whatever sphere you are in. I do not think
you really need ask questions about the ITC Code to achieve
that.

MR. MORRIS: (To the witness) Is there anything else you would
like to say about the Code as it exists? I think we have
dealt with -----

MR. JUSTICE BELL: Why not go on to the proposed changes?

MR. MORRIS: Yes.

MR. JUSTICE BELL: I think you can ask Ms. Dibb her view, quite
shortly.

MR. MORRIS: I will just say that I wanted to deal with
complaints to the present code, individual complaints, but
maybe we can deal with that later, as it is now quite a
relevant time to come up to your -----

MR. JUSTICE BELL: Let us go to the proposed amendment while we
have the old one fresh in mind.

MR. MORRIS: Yes. (To the witness) If you can go to Responsible
Food Advertising? We do not really need to go into the ASA
Codes, the printed codes in detail, although I might want
to come on to them a bit later on.

Generally, in your opinion, do the same areas of concerns
that you have expressed about the ITC relate also to the
ASA guidelines?
A. In general, yes. The codes are worded differently, and
they are different bodies and they are differently
constituted in their procedures and accountability; the
