Day 048 - 08 Nov 94 - Page 37
been served. I do not know if there have been copies made
for the judge this morning? I am not sure if they have
been made today. If I can just quote a couple of relevant
bits again?

MR. JUSTICE BELL: Identify what the pamphlet or book is.

MR. MORRIS: It is Eat Well.

MR. JUSTICE BELL: Who is it produced by?

MR. MORRIS: It is the action plan from the Nutrition Task Force
to achieve the Health of the Nation targets.

MR. JUSTICE BELL: Identify the page, and then put the part that
you want.

MR. MORRIS: Produced by the Department of Health, March 1994.
Pages 12 and 13 are specifically about advertising; and the
relevant bits that have been "bolded" in that section are
the ones we have already mentioned, which is advising the
ITC to amend its Code of Practice -- inviting them -- and
particularly in regard to children; and then there is
another point which says, point 21 -- that was point 17 --
point 21 says:

"The Nutrition Task Force recognises that the advertising
industry already seeks to conduct its business in a
professional and socially responsible manner. It hopes to
build on this by encouraging the food and advertising
industries to recognise the marketing opportunities
contained within the dietary changes proposed in the Health
of the Nation initiative and to encourage them to use these
opportunities in a positive way."

I know I sort of rushed through that, but did you grasp
what they are trying to say there?
A. I think so, yes.

Q. Are they saying, in parts of it, that new products could be
developed and marketed that were better able to fit in with
the government's dietary guidelines and already existing
ones?
A. I guess that would be a conclusion you could draw from
that statement, yes.

Q. I know that your department has not had any contact from
the Corporation about the Health of the Nation
implications, that is what you have said, but do you know
if the company is developing and planning to market new
products that would be healthier products, or whatever?
A. Well, again, it is a question of defining healthy
products as opposed to healthy diets. We have never been
averse to looking at new products, anyway. We have done it
before. I mentioned salads. We will look for
opportunities in the marketplace accordingly to suit our
strategies.

Q. But do you know of any -- because, obviously, your
department would have a great deal of prior warning, would
