2 Q. The company has gone on record as supporting the Health of
3 the Nation recommendations about the nation's health. So
4 are you aware that advertising is considered to be an
5 important part of the equation, if you like, leading to
6 public health matters? Are you aware of the----
7 A. We would try not to do anything that is misleading in
8 any way in our advertising, that contravenes any ruling
9 that there may be, certainly.

11 MR. MORRIS: Yes. But are you aware that in the Health of the
12 Nation document, there are two specific points under the
13 heading "Opportunities for promoting healthy eating"?

15 MR. JUSTICE BELL: Think about what you are trying to achieve.
16 Would it not be much simpler to ask whether he is aware of
17 the Health of the Nation and any recommendations it may
18 make? If the answer to that were "no", you really do not
19 have to ask another question about it; you could comment
20 later.

22 MR. MORRIS: (To the witness) First of all, is your department
23 aware of the recommendations of the Health of the Nation
24 pamphlet issued by -- well, with government sanction?
25 A. Formally, I am not aware that they would know. Whether
26 they know as individuals, I am not sure.

29 A. As I have said, formally aware, I do not believe so, as
30 a department.

32 Q. So, in other words, the recommendations applying to the
33 responsibilities of companies regarding marketing and also
34 advertising which are in the Health of the Nation pamphlet,
35 have not been communicated to your department, as far as
36 you know?
37 A. As far as I know, no.
