Day 048 - 08 Nov 94 - Page 26

it must have been shown at least ten times, or you could
not have anyone who has seen it ten times?
       A. That is correct.

  Q. You cannot tell us how often it was shown, but it must
follow that it was shown more than 6.2 times?
       A. Yes.

MR. JUSTICE BELL: You do not know have to go any further on
this. We can see if there is any more evidence about it
and, at the end of the day, you can make your comments,
Mr. Rampton can make his, and there we are.

MS. STEEL: There were just a few more points I want to make.

MR. JUSTICE BELL: Certainly do that. But we may have gone as
far on just what it means as we can.

MS. STEEL: Yes. (To the witness) Just looking at Border
region, which is page 249, again, this year there are
42 weeks of advertising to kids and just eight weeks to
       adults?
       A. Yes. There you have the TV AM clearly influencing the
       numbers of children's weeks.

MS. STEEL: I think you have got two weeks of adults TV AM, as
well? You have got two weeks of adults TV AM there, as
well; that is right, is it not?

MR. JUSTICE BELL: What you are saying is that the figure -- if
we go back to my page 245 -- the figure of 43 weeks,
although it is against the line which has all the black
blocks in, is in fact the total of those weeks which are
blocked in black and/or have a cross above them?
       A. It looks like it. I have not added them up in detail,
       but it looks that way.

MR. JUSTICE BELL: I have just related it to the black blocks
       line.

MS. STEEL: I think, in previous years, it was just a black
block, but in this year it relates to both the crosses and
       the black blocks.

MR. RAMPTON: The only way the arithmetic works out is if you
use the crosses as well as the blocks.

MS. STEEL: (To the witness) Of course, that also means, does
it not, that in very many of those weeks on page 245 not
only have you got the black blocks, you have also got the
       TV AM?
       A. That is correct, yes.

MS. STEEL: Again, with Central Scotland, including TV AM,
there are 41 weeks of advertising on television aimed at
children and only six aimed at adults. To save time, I
will not go through all the remaining years.

MR. JUSTICE BELL: You only need put anything which arises
afresh in any of those years which you consider to be
