Day 047 - 07 Nov 94 - Page 62
What I am concentrating on at the moment is completing all
the advertising witnesses and if we do not complete them on
Friday, then it seems to me there is a reasonable prospect
of completing them by close of day on Monday. That is not
unrealistic from anyone's point of view and then we can
talk on Monday about when we start up again and what with.

MR. MORRIS: We will try and contact Miss Gallatley to come on
Wednesday if she is still available.

MR. JUSTICE BELL: That was when she was due to come.

MR. MORRIS: I did indicate there might be a problem because this
week seemed to be all over the place but I will certainly
contact her and also Ms Dibbs can come on Thursday to be
ready when Mr. Miles has completed his evidence.

MR. JUSTICE BELL: Yes, we may start Ms Dibbs on Thursday. Well
look, the proposal then is we go to Mr. Hawkes tomorrow. We
hear Miss Gallatley on Wednesday. Ring her as soon as you
can when you get out of court today to put that to her.

MS. STEEL: If Miss Gallatley is coming on Wednesday would it be
possible to start an hour later because we have not
actually had a chance to discuss the evidence with her.

MR. MORRIS: We have not actually met her to talk to her at all.

MR. JUSTICE BELL: That might well be perfectly possible, if you
said you weren't ready to go, you wanted to start at half
past eleven, then I do not suppose I could say no, but the
first thing is to make sure that she can come on Wednesday.
I do not want you to offer her a choice unless she has a
very good reason for not coming on Wednesday. She really
must come on Wednesday which is the day on which it was
proposed to call her in any event. If you tell me tomorrow
that you have contacted her, she is not coming, for all I
know she may be prepared to come down on tomorrow
afternoon, so you can speak tomorrow evening with her. Make
your best arrangements in relation to that. Try and avoid
losing an hour on Wednesday because obviously we want to
make best use of the time. If you find yourself in an
impossible situation as far as that is concerned, let me
know. But we will continue with Mr. Hawkes tomorrow. I
really think we ought to be able to finish Mr. Hawkes
comfortably tomorrow especially now you know what answers
Mr. Green has given from his point of view. We will start
Miss Gallatley as soon as we can on Wednesday, subject to
you telling me there is any problem tomorrow. We will have
Mr. Miles and the remainder of Miss Gallatley if there is
anything left on Thursday and begin Ms Dibbs if there is
time to on Thursday.
Right, we will resume at 10:30 tomorrow morning.
The court adjourned until the following day.
