Day 047 - 07 Nov 94 - Page 20
A. I am sorry. Is that a question?

MR. MORRIS: As far as I am aware, unless I am contradicted by
the Plaintiffs, they have -- just for your information.

I just want to quote to you from a McDonald's document, the
Nutritional Information Guide in some of their stores or
all of their stores. I will just quote it to you. They
have been read out any number of times before.

MR. JUSTICE BELL: Which one is it? Is it one of----

MR. MORRIS: I do not know which one it is.

MS. STEEL: It is not in the trial bundles, I do not think. It
is the one that Mr. Hill had several copies of.

MR. MORRIS: I just want to quote is, just to----

MR. JUSTICE BELL: Just say what the document is. Do you know?

MR. MORRIS: It is the Nutrition Guide. If you remember,
Mr. Hill did have about 50 copies at one stage, because we
could not find it in the trial bundles, and that is when
Mr. Rampton made a mistake and we all ended up in giggles
about it.

MR. JUSTICE BELL: Just read it out, so I can hear it, first of
all. (To the witness) Just listen, Mr. Miles. You may be
asked a question about it.

MR. MORRIS: McDonald's have said in this pamphlet: "Every time
you eat at McDonald's, you will be eating good nutritious
food." Then, later on, they say: "At McDonald's we have a
responsibility to help our customers eat a healthy balanced
diet."

Would you say, bearing in mind those statements, that
McDonald's have a responsibility in their advertising, that
advertising does relate to diet?
A. Advertising relates to food, and food is part of diet,
yes.

Q. What I am trying to say is that if McDonald's accept the
Health of the Nation recommendations, and portray their
food as attractive, desirable and healthy -- would you
accept that is a fair comment?
A. Yes.

Q. That they would have an obligation in their advertising to
reflect those policies?
A. I am afraid you will have to be more specific than
that, when you say "those policies".

MR. JUSTICE BELL: Put what you suggest they should be doing?

MR. MORRIS: Well, you have seen their advertisements?
A. Yes.

Q. Would you say that they portray their food as attractive,
