Day 046 - 04 Nov 94 - Page 40

       A. It is my feeling that we have continued with the
balance theme in other advertising. As to whether it
appeared in this particular quarter, it does not look like
       it did.

  Q. Have you any problem with admitting that you might have
       made a mistake in 1987?
       A. No, I have no problem with admitting we might have made
       that mistake.

  Q. Would you accept that you made a mistake in 1987 with your
campaign and, for that reason, you dropped, effectively,
the main theme of the campaign, because of the Attorneys
       General?
       A. No, we did not make a mistake except for the one error
       in that campaign.

MR. RAMPTON: My Lord, I do not believe the witness has answered
the second part of a two part question, which was that the
recognition of the mistake was thanks to the intervention
of the Attorneys General; in other words, that the campaign
was discontinued because of the information -- which was
the second part of the question.

MR. JUSTICE BELL: I think, between the previous answers and
that answer, we have what Mr. Green means to say.

MS. STEEL: When did you notice that there was a mistake in the
       milkshake ad?
       A. When it was brought to our attention on the part of the
       Attorney General.

MR. MORRIS: Have you any evidence at all of anything other than
what has been disclosed from 1988, for example?

MR. JUSTICE BELL: You mean documentation, not evidence?

MR. MORRIS: Yes; any other documentation about the claimed
       continuation of this campaign?
       A. Again, all the documentation that we had in our offices
was given to legal counsel when they asked for it.

MR. MORRIS: I think we can put those documents away.

MR. RAMPTON: My Lord, I would be grateful if Mr. Green kept
       volume VIA.

MR. MORRIS: So, as we said before, there have been complaints
about some of your advertising material, culminating in
terms of -- I have culminated with this Attorneys General
complaint. You said before that the only -- all those ads,
all those complaints I have referred to or indicated, or
whatever, the things I have mentioned which are to do with
public health, the health of the public, yes? (sic) Is
that correct? The Attorneys General were concerned about
       the health message?
       A. Yes.

  Q. The only example you can think of, of a complaint where you
stopped your ad because you got a complaint, was from the
