1 that is not going to be pursued, you are content to rely on
2 other witnesses so far as other factors are concerned,
3 although Mr. Bateman does touch on other factors.

5 MR. RAMPTON: I know he does, but I am content to leave it to
6 others. If it is simply a question of trees, then I do not
7 need Mr. Bateman. If it is a question of whether the paper
8 making process adverse environmental effects, then I do
9 need Mr. Bateman, but I only propose to call him if the
10 Defendants, by some means or another, they having said that
11 they have abandoned Miss Carroll, are themselves proposing
12 to lead any evidence.

14 MR. JUSTICE BELL: Thank you. What I would like is anything
15 that you wish to say at this stage on, firstly, the
16 question of Miss Carroll and Mr. Bateman; secondly, as to
17 order of advertising witnesses and when they may be taken;
18 thirdly, the question of the length of any break between
19 such advertising witnesses as we can call at this stage and
20 going on to the question of amendment, and recycling and
21 waste.

27 MS. STEEL: We would like to get advice, really. We have not
28 really had the chance to take advice.

31 can, simply because it is not just a question of whether
32 Mr. Rampton needs to call Mr. Bateman. Indeed, if you were
33 left in any doubt about that, it might be that he would
34 just call him, but if there is no need to call Mr. Bateman,
35 we have two days in the schedule which we can use for
36 something else. So it has that importance to know as soon
37 as possible.

45 actually calling evidence, putting a positive case in the
46 sense of calling evidence, on the pulp processing side,
