Day 273 - 03 Jul 96 - Page 42

MR. JUSTICE BELL: Well, I would like you to tell me more about
this tomorrow because what will be completely unattractive
to me is to find just at the point when I think we are
completing the evidence, hopefully in about two weeks time,
you suddenly say, we do not have this or that document, so
that Mr. Rampton is put to calling a witness to prove it.

MS. STEEL: Right. Well, I have given an indication of at least
one where Mr. Rampton will have to do that if he wants to
prove a document. The pig-sheep thing.

MR. JUSTICE BELL: Well, you have got the rest of today. You
may well have time tomorrow. You have got a day on Friday
when we are not sitting. I assume that if we finish Miss
Lapport tomorrow, you must, before you go into the witness
box on Monday, be able to say which, if any, documents are
there apart from the one you have already indicated you do
       not accept.

MS. STEEL: The Plaintiffs also have that time to make contact
       with Mr. Bishop.

MR. JUSTICE BELL: I am sorry. It is just not helpful to make
comments like that. But you must give which documents
there are otherwise I will find myself in the position
which I may have to say I will hear no more evidence after
the middle of July except any evidence which the Plaintiffs
wish to call at any stage in order to prove documents on
Mrs. Brinley-Codd lists of which they have had late notice
that you do not accept. That is not a course which I would
like to adopt but it is the only course which would be fair
to the Plaintiffs. So to achieve that end, you really must
to avoid me having to do something like that, you really
must on Monday morning before you go into the witness box,
that time at the latest, tell Mrs. Brinley-Codd which, if
any, documents apart from the one you have mentioned you
dispute so that they have got to be strictly proved if,
indeed, the Plaintiffs can strictly prove them.

We will adjourn now and resume with Miss Lapport's
       evidence tomorrow morning.
