Day 273 - 03 Jul 96 - Page 40

MR. MORRIS: This is before we got the note off Michelle Hooker.

MR. JUSTICE BELL: Yes, I understand that. But the leaflets
which he refers to Ms. Steel organising the printing of for
the Greenpeace fayre, may, in fact, have been leaflets for
an IMF/Bank of England protest, then there was no need to
recall him, but as I understood it that admission was not
forthcoming. I make no criticism of that, but in the light
of the fact that it was not forthcoming I felt that Mr.
       Bishop should come back.

MR. RAMPTON: I know that. My Lord, can I put it like this. I
would feel happier about making that admission I could
speak to, or Mrs. Brinley-Codd could speak to, Mr. Bishop.

MR. JUSTICE BELL: I am perfectly content with that.

MR. RAMPTON: "Do you accept it?"

MR. JUSTICE BELL: Unless Ms. Steel wants to say more to me.
If you make an admission to that effect I see no need for
Mr. Bishop to come back to have it put to him. If you feel
unable to make the admission he must come back at some
stage and it matters at all not when before the end of the
       evidence.

MR. RAMPTON: Speaking for myself, I think it is quite likely he
has made a mistake or he has misremembered what the talk
about the leaflets and Ms. Steel referred to, but I feel a
       bit uncomfortable.

MR. JUSTICE BELL: I do not see why you should make the
admission just because it seems sensible for you to make it
without a check with Mr. Bishop.

MR. RAMPTON: Well, if I had your Lordship's permission to
       check.

MR. JUSTICE BELL: I do not know if it might be used at the end
of the day as the key to his reliability.

  MR. RAMPTON: Exactly.

MR. JUSTICE BELL: So what I suggest you do you take
instructions, if you feel that you are able to make the
admission, subject to anything Ms. Steel says now, I will
not give leave for his recall. If you do not make the
admission then he should come back at some stage before we
complete the evidence in the middle of this month.

MS. STEEL: If he is going to come back I would like him to come
back before I give evidence. He was set to come back
tomorrow, so it is quite simple for them to contact him.

MR. JUSTICE BELL: I do not accede to that. It is a matter of
one detail and there is absolutely no need to hold up your
       evidence for it.

MS. STEEL: I am not saying my evidence should be held up, but
