3 A. It would have been some occasions when someone from
4 the London Greenpeace office might 'phone us up and simply
5 ask us to send down 50 or 100 copies at a time. There
6 would have been other occasions when we were in London
7 ourselves on various events including, obviously, the
8 various fayres that London Greenpeace has arranged over the
9 years and on those occasions would have brought leaflets
10 with us to display on our own stand and any that were left
11 over at the end of the day we would likely to have left
12 behind for London Greenpeace to use.

14 There were some occasions where our members may have
15 been in London on other personal matters and may have gone
16 along to demonstrations being held in London and would have
17 taken a handful of leaflets themselves to use on those
18 occasions. So, by various means at various times small
19 quantities because again we never printed very large
20 quantities of them because they were still relatively
21 expensive.

23 Q. You are talking about the fact sheet?
24 A. Yes. So, over the years probably a few thousand may
25 have been sent down in that way through various routes.

27 MR. RAMPTON: My Lord, I am troubled by this. There seems to
28 have been an expanding case. It is already a new case, but
29 it seems to be expanding. We have never had a witness
30 statement to that effect from Mr. Smith or from the
31 defendants, or any of their publication witnesses. I am a
32 little troubled by it. It was put elliptically to Mr.
33 Nicholson when he was shown the wrong kind of Veggies
34 leaflet, because it was one which was more modern than was
35 in existence in 1989 but that is as far as it went, and I
36 am a little troubled by this.

38 MR. MORRIS: Well, it is in the statement of 20th May 1996,
39 which I have read out, and asked him how it was supplied to
40 Greenpeace London and that witness explained how that
41 process took place.

43 MR. RAMPTON: No, my Lord. It is a different point entirely.

45 MR. JUSTICE BELL: Well, I thought it was implicit in what was
46 put to Mr. Nicholson that insofar as anyone said they had
47 seen a fact sheet with the familiar cartoon and subtitle on
48 the front of it, that that might have been a Veggies
49 version rather than the actual fact sheet--

51 MR. RAMPTON: No, this is what was put to Mr. Nicholson.

53 MR. MORRIS: It was the front cover that was important.

55 MR. RAMPTON: No, and when I re-examined Mr Nicholson I showed
56 him this and I said: "Have you ever seen anything like that
57 before?" He said: "No, I have not." And he did not see
58 it at the 1989 demonstration, and it is not surprising.
