Day 259 - 10 Jun 96 - Page 13

MR. JUSTICE BELL: I do not remember seeing it. (Handed)

MS. STEEL: (To the witness) Do you see in the letter that it
says in the second paragraph that: "The night of the 16th
was marked by the worst hurricane in the South East in
200 years, which effectively stopped most of the problem,
although we had demonstrations at about 25 stores during
       the day"?
       A. Yes.

  Q. There is no reference there to a picket of Head Office, is
       there?
       A. No.

  Q. But there is a reference to the hurricane, which you do not
remember as being on that date?
       A. That is right.

  Q. Would you accept that your memory is, obviously, not as
good as you hoped it was?
       A. No. I do not connect the two at all.

  Q. Can you then turn to tab 24, please, in the same -----

MR. JUSTICE BELL: I would like someone to tell me to put that
       in due course.

MR. RAMPTON: My Lord, maybe it is best if it is goes behind
Mr. Carroll's statement -- the simplest thing I can think
of. It may be that Mrs. Brinley-Codd has already put it
behind, for your Lordship, Mr. Nicholson's statement. She
seems to be uncertain about that.

MR. JUSTICE BELL: Yes. I will have a look later.

MS. STEEL: (To the witness) Do you see that this is some kind
of press release from Greenpeace London, dated
       October 1988?
       A. Yes.

  Q. When you were giving evidence, you said the 1988 picket was
on October 16th and that it was much the same as the
others. Do you see that in this leaflet it refers to
October 16th being on a Sunday?
       A. Yes.

  Q. In which case, you would not have been in the office on
       that day, would you?
       A. No. It was not held -- the demonstration outside the
office was not held on a Sunday.

  Q. So it was not held on October 16th, like you said it was?
       A. No, no. Sorry, I missed it by a day.

  Q. Do you see that there is no mention on there of a picket of
       Head Office?
       A. No. It just says that you are going to have your usual
       day of action against McDonald's.
