Day 257 - 06 Jun 96 - Page 06

MR. JUSTICE BELL: Can I write in those what document numbers
       they were last time?

MR. RAMPTON: They are the same, I hope, because
Mrs. Brinley-Codd based the new index on the numbering
discussion which we had last time.

MR. JUSTICE BELL: Yes. Let me just check because I do not want
to get lost. I have the 'Fast Track Attribute Movement'.

MR. RAMPTON: Coloured columns, that is AF1. AF2, partly what
was there before, but now there is a single sheet at the
back called 'Fast Track Attribute Movement', which was one
       of the new documents.

MR. JUSTICE BELL: Yes, I have that.

MR. RAMPTON: Then AF3 was originally just a sheet of
frequencies expressed in percentages. Now, there should be
behind that perhaps the important document, this document
having been made by Mr. Fairgrieve, in a sense at your
       Lordship's request.

MR. JUSTICE BELL: I have the 'Number of People Eating at
McDonald's' but I have also got there something which says
'Fast Track Attribute Movement 88 to'--

MR. RAMPTON: That should be at the back of appendix 1.

MR. JUSTICE BELL: At the back of it?

MR. RAMPTON: Appendix 1, my Lord. I am sorry, 2. Appendix 2.

MS. STEEL: So, 'Number of People Eating at McDonald's' is the
one that Mr. Fairgrieve prepared for this court case.

  MR. RAMPTON: That is right.

MR. JUSTICE BELL: All that has happened is I have got two copies
of the document which should be at the back of--

MR. RAMPTON: Perhaps I could ask Mr. Fairgrieve to take the
same bundle, yellow 5, and to turn to tab 3, so that he can
confirm the documents have been put in the right place.
Mr. Fairgrieve, do you have tab 3 there, is that your
       statement?
       A. Yes, it is.

  Q. Behind your statement there should be some coloured
       columns.

MR. JUSTICE BELL: Bring it down in front of you.

MR. RAMPTON: Which is an unchanged appendix?
       A. Yes, I have got the columns.

  Q. This is a Taylor Nelson document?
       A. That is correct, yes.

  Q. If you turn to appendix 2, I hope your have tabs, mine have
