Day 257 - 06 Jun 96 - Page 05

MR. JUSTICE BELL: I have studied in great detail the ones which
I am asked to study in great detail. But I think you had
better bear in mind what I have just said. The mere fact
someone has read more about a subject than I have does not
necessarily make them an expert on it, not within
       evidential terms.

MS. STEEL: I have not got anything to hand about his
       experience, so I am not--

MR. JUSTICE BELL: No. I remember we had a very similar
discussion when he was called in the first place. What I
would like before the end of next week is some indication
of what additional matters he is going to give in evidence.

MR. MORRIS: He told me he will try and do it this weekend.

MR. JUSTICE BELL: Very well. Shall we go to Mr. Fairgrieve?

MR. RAMPTON: Yes. Recall Mr. Fairgrieve.

                   Alistair Fairgrieve, recalled

MR. RAMPTON: Mr. Fairgrieve is still under oath, whenever it
       was.

MR. JUSTICE BELL: Yes. Let me make a note. Thank you.

MR. RAMPTON: May I remind you, your Lordship, as best I can, I
am afraid my account is defective and your Lordship may
have in fact a clearer recollection of events, but
Mr. Fairgrieve was last here on Wednesday, 17th May 1995.
On that occasion some additional documents preceded him.
He came back, essentially, for further cross-examination.
Some of the documents which came with him on the last
occasion were documents in the nature of questionnaires,
which were the questionnaires which had been used for some
of the surveys which originally with his statement and his
appendices. Perhaps the important document that he brought
with him last time was a calculation of what the frequency
       of the--

MR. JUSTICE BELL: We did not go as far as him explaining how he
set about that, about what it meant.

MR. RAMPTON: That is right. Now, my Lord, there should now be
in your Lordship's yellow bundle 5 behind Mr. Fairgrieve's
statement at tab 3, of the first section, a proper index of
all the appendices. I have a spare one if your Lordship
       does not have it.

MR. JUSTICE BELL: I do not have it at the moment. What I did
is I put post-its with the documents numbers 1 to 6 on
them, and I looked at them again yesterday.

MR. RAMPTON: What that tells, your Lordship, is by reference to
the word 'also' underlined in each appendix which were, in
May 1995, the new documents. Of course, it now tells your
       Lordship where to find them.
