1 MR. JUSTICE BELL: I have studied in great detail the ones which
2 I am asked to study in great detail. But I think you had
3 better bear in mind what I have just said. The mere fact
4 someone has read more about a subject than I have does not
5 necessarily make them an expert on it, not within
6 evidential terms.

8 MS. STEEL: I have not got anything to hand about his
9 experience, so I am not--

11 MR. JUSTICE BELL: No. I remember we had a very similar
12 discussion when he was called in the first place. What I
13 would like before the end of next week is some indication
14 of what additional matters he is going to give in evidence.

29 MR. RAMPTON: May I remind you, your Lordship, as best I can, I
30 am afraid my account is defective and your Lordship may
31 have in fact a clearer recollection of events, but
32 Mr. Fairgrieve was last here on Wednesday, 17th May 1995.
33 On that occasion some additional documents preceded him.
34 He came back, essentially, for further cross-examination.
35 Some of the documents which came with him on the last
36 occasion were documents in the nature of questionnaires,
37 which were the questionnaires which had been used for some
38 of the surveys which originally with his statement and his
39 appendices. Perhaps the important document that he brought
40 with him last time was a calculation of what the frequency
41 of the--

43 MR. JUSTICE BELL: We did not go as far as him explaining how he
44 set about that, about what it meant.

46 MR. RAMPTON: That is right. Now, my Lord, there should now be
47 in your Lordship's yellow bundle 5 behind Mr. Fairgrieve's
48 statement at tab 3, of the first section, a proper index of
49 all the appendices. I have a spare one if your Lordship
50 does not have it.

52 MR. JUSTICE BELL: I do not have it at the moment. What I did
53 is I put post-its with the documents numbers 1 to 6 on
54 them, and I looked at them again yesterday.

56 MR. RAMPTON: What that tells, your Lordship, is by reference to
57 the word 'also' underlined in each appendix which were, in
58 May 1995, the new documents. Of course, it now tells your
59 Lordship where to find them.
