Day 255 - 23 May 96 - Page 20

going to get anywhere via this article.

MS. STEEL: I do not know, I think it is the overall picture and
clearly follows lots of examples of where they have done
       it.

MR. JUSTICE BELL: One has got to sort of draw one's boundaries
a bit otherwise it gets quite out of hand.

MS. STEEL: I will try and deal with it a bit quicker.

MR. JUSTICE BELL: Yes. I do not think you will harm your case
if you do as long as you -- not necessarily in relation to
every document, but in relation to one or two of the main
ones which you have already done, for instance, with regard
to Veggies -- make it clear what the main point is so that
I understand it and put it to Mr. Nicholson which you have
done. Then you can pick it up in argument, or you can give
evidence in due course, if you wish, about the effect this
had on you and so on, if it did.

MS. STEEL: But it is also the point because Mr. Rampton said he
was going to use the files to rely on it being all down to
       us sort of thing.

MR. JUSTICE BELL: A lot of that is argument. You do not have
to put everything. I suppose there are two points, whether
any of it can be seen to have been lifted from the
London Greenpeace leaflet, I am probably able to judge that
for myself. The other question is whether the
London Greenpeace leaflet was one manifestation of a series
of communications which might have been going on between
people which also manifested itself in other areas, and Mr.
Nicholson has quite candidly said, "I do not know about
that". So, so far as he is concerned, I would suggest, so
far as that consideration, as opposed to the direct lift
consideration is concerned, you cannot take it any further
       with him.

MS. STEEL: Right. The one in tab 14 from The Today newspaper
on Monday, 7th August 1989 and it says, "action taken
September 1989". I am not sure why it has that.

MR. JUSTICE BELL: Yes, it is 7th August 1989.

MS. STEEL: Yes. The paragraph that is marked is underneath
       the photograph?
       A. Yes?

  Q. You do not have any evidence that Liz Crosby made that
statement as a result of information from
       London Greenpeace?
       A. I have no idea.

  Q. Do you remember this one related in an apology in The Today
newspaper, I think. I think there was an apology in open
court actually. I think it is one of the ----
       A. I can remember an action against The Today newspaper.

  Q. Right.
