Day 255 - 23 May 96 - Page 10
MR. JUSTICE BELL: I think, if a point is going to be made on
this in due course, we had all better have a copy to put
in.

MS. STEEL: OK. It must have got missed out of the bundle.

MR. JUSTICE BELL: Can we have copies first? (A short pause
while copies of the document were made).

MR. MORRIS: Maybe if we can get hold of one?

MR. JUSTICE BELL: Can you remember what it said?

MS. STEEL: No.

MR. JUSTICE BELL: No-one else has a copy either.

MR. RAMPTON: No, my Lord, I am sorry, ours is deficient too.

MR. JUSTICE BELL: Ask on the basis of what is there. Put your
question.

MS. STEEL: The thing is it is a bit pointless without the whole
of it, but maybe if we look at tab 7 for now and then come
back to it.

MR. JUSTICE BELL: Yes.

MS. STEEL: (To the witness): Do you remember this tab 7? It is
the coming of the Greens?
A. Are we back to the first tab?

Q. Yes, sorry, the words complained of.

MR. JUSTICE BELL: Do you remember that?
A. I do not off hand.

Q. Just pause a moment. Finish tab 7 first. Is there
anything more you want to ask about tab 7 if he cannot
remember it?

MS. STEEL: I was going to ask which parts it was that the
Company sued over?
A. I cannot remember this one at all.

Q. Sorry, took some kind of action over?
A. Yes. I cannot remember this one at all. I said I was
responsible for most of the actions regarding publications
but other departments may well have got something and taken
it straight to Barlows. I cannot remember this one.

Q. It seems to be about employment and CFCs, although ----
A. Yes. I have not read it through but I cannot remember
seeing it.

Q. The bit about CFCs is just saying that you were phasing
them out so I cannot imagine you took any action?
A. In which case it may have gone to solicitors via the
quality control people who were involved in CFCs, the
purchasing department.
