     2   MR. JUSTICE BELL:  I understand Mr. Brett has not turned up.

     4   MR. MORRIS:  He has not materialised.  He knows all the
     5        details.  I spoke to him on Sunday.

     7   MR. JUSTICE BELL:  When did you speak to him last?

     9   MR. MORRIS:  Sunday evening.  I do not have his phone number on
    10        me, so just have to hope that he turns up.

    12   MR. JUSTICE BELL:  Yes.  Can we carry on with Mr. Nicholson?

    14   MS. STEEL:   If I can have a couple of minutes?

    16   MR. JUSTICE BELL:  Yes, I will certainly give you that.  What
    17        I suggest, we carry on with Mr. Nicholson.  If Mr. Brett
    18        arrives, at a convenient break in Mr. Nicholson's evidence,
    19        your further cross-examination of him, we will stop.
    20        I will rise so that you can speak to Mr. Brett, and then we
         will continue with him.  That is supposing he comes.  Do
    22        you have anything to say?

    24   MR. RAMPTON:  No, nothing at all.  I have an apology to make.  I
    25        was looking at Mr. Brett's personnel file last night.
    26        I previously thought that it was not relevant, but I did
    27        spot last night one part of it which may be relevant which
    28        relates to the chronology of his employment at McDonald's.
    29        In fact, I could have blanked out lots of it.  I have not
    30        done so, I have copied the whole thing.

    32   MR. JUSTICE BELL:  If and when you have a break, because he has
    33        arrived.

    48        if need be, have a slightly longer break so you can ring
