Day 209 - 25 Jan 96 - Page 08
employment bureau stating that McDonald's in Bath had said
to them that I have been dismissed for misconduct, for
missing two shifts. I felt as though I had been dismissed
and McDonald's considered that I had been."

The complaint continues over the page. "In the three years
that I worked for McDonald's, I received no disciplinary
action at all and had an exemplary service record with the
Company. It is McDonald's disciplinary policy to give a
warning for misconduct, then a written warning for another
breach of contract and, finally, a final written warning
before dismissal. I was dismissed without being given a
warning of any sort or any chance of appeal against the
decision. I was not even formally contacted to tell me of
my contract termination.

I have already written to the Store Manager of McDonald's
Bath merely asking for an explanation of how my contract
ended. I received nothing in return which I consider
blatantly inconsiderate. I hope you will help me take the
matter further."

MS. STEEL: Can I just say something else that might be
relevant as well? On the top of page 1546, at question 6,
it says: "Please give the number of normal basic hours you
work per week", and it says "48 hours per week", and it
also gives the date of employment which actually says
April 1989.
A. Yes. I was a bit unsure.

Q. Would that be the right date that is here?
A. Yes, definitely, because it was Easter that I joined.
I remember that, but I could not remember the year.

Q. Are the hours correct?
A. Yes; everything on there is correct.

MR. MORRIS: So, with that amendment to what you said earlier on
about you actually started at McDonald's on 5th April 1989
---
A. Yes.

Q. -- do you verify from the witness box what you said here in
this statement to the tribunal?
A. Yes.

Q. It may be relevant to know that on page 1551 there is the
result of this application which, although it is almost
impossible to read, I think it is accepted that Mr. Logan
was paid £750 and also had his job back. I do not know if
Mr. Rampton wants to bring anything up about that. Can we
put that on one side and leave that now?

MR. JUSTICE BELL: Yes. Would you mind putting it back on the
shelf?
A. This one here?

Q. Yes, that one.

MR. MORRIS: The next statement is what you might call your main
