     2        agreeing, I think you should put it to him.

     4   MS. STEEL:   OK.

     6   MR. JUSTICE BELL:  He may well be agreeing with what was said
     7        about the kitchen and the back room.

     9   MS. STEEL:   (To the witness)  So you agree that all of those
    10        things were problems that needed sorting out?
    11        A.  I probably put some of them forward, to be perfectly
    12        honest with you.  The whole idea of the rap session -----

    14   MR. JUSTICE BELL:  You agree with what is under "kitchen and
    15        back room", do you?
    16        A.  Definitely, yes.

    18   MS. STEEL:  Do you agree with what is under "dining areas" and
    19        the "back-up areas"?
    20        A.  I would not have any experience of the dining areas at
    21        that point in time, so I would have left it to the people
    22        that actually worked on the dining area.

    24   Q.   What about the back-up area?
    25        A.  Again, those were problems at the time which have been
    26        resolved.

    28   Q.   On page 240, under "Policies and Procedures", the second
    29        question about:  "What do you feel about the Company's
    30        policies on discipline (applied fairly, consistently,
    31        confidentiality, right to appeal explained, etc)", and the
    32        answer being: "More consistency and discipline re lateness
    33        and absenteeism."  You would agree with that?
    34        A.  I would have probably kept quiet at that point, to be
    35        perfectly honest.

    37   MR. JUSTICE BELL:  Can you keep your voice up, please, Mr. Cox?
    38        A.  I probably would not have got involved in that
    39        discussion at all; I would have just sat that one out.

    41   MS. STEEL:  So, did you disagree or did you just -----
    42        A.  As a person that suffers from being late now and again,
    43        I would not found it my place to disagree with the comment.

    45   Q.   Had you been disciplined for being late?
    46        A.  Yes, I have been.

    48   Q.   On a lot of occasions or just once or twice?
    49        A.  I would not -- well, I had or I have a written warning
    50        for it.  I would imagine I have been disciplined three or 
    51        four times.

    53   MR. MORRIS:  The disciplines that you had were for lateness and
    54        absenteeism?
    55        A.  Not for absenteeism, no.

    57   Q.   Lateness?
    58        A.  Yes.

    60   Q.   But there are days when you have not turned up?
