Day 203 - 12 Jan 96 - Page 18

MR. RAMPTON: Under "Conclusions", there is a section which
starts with "Previous goals and objectives".

MR. MORRIS: His goal is identified as being to achieve no Bs or
       Cs, i.e. set a goal -----

MR. JUSTICE BELL: I am sorry. We have left Mr. Skehel out of
this. (To the witness): Would you mind getting the volume
at the very top of the bookcase with a "2" against a green
back, turning right to the back, into divider 31?
       A. Right to the back?

  Q. Yes, divider 31.
       A. OK.

  Q. Sorry, 32. In fact, if you go about a dozen or so pages in
from the back, you will see that there are page numbers at
the bottom. Turn to one with "62" stamped on the bottom,
       please.
       A. Yes

  Q. That is an annual performance review done by Mr. Davis on
Mr. Coton and dated 1st November 1990. Bottom of page 62,
       top of page 63.

MR. MORRIS: Is it clear, Mr. Skehel, that the third goal from,
presumably, the previous performance review, annual
performance review and objectives, the third goal and
objective was to get straight As on the full field,
       and -----

MR. JUSTICE BELL: I suggest you start at the very beginning of
PR on page 59 at the top. "In your interim PR I stated that
for six months from your previous annual PR you had
performed quite well obtaining Bs but never clipping the
As." Then we go to the bottom of 62 and the top of 63.

MR. MORRIS: So, in the previous six months, he had been
obtaining Bs? I do not know.

MR. JUSTICE BELL: Have you read the top of page 63, as well?
       A. Yes.

  Q. What is being suggested to you is that if you turn back to
54, which is interim performance review, 1st May 1990?
       A. Yes.

  Q. Second sentence: "I feel the store operates at a solid B
       level but never maintains As"?
       A. OK.

  Q. Are the assessments you have read there, if your evidence
is accurate, quite inconsistent with what you say you
found, almost as soon as you arrived. That is what, in
effect, is being put to you; do you accept that?
       A. I guess, if that is what Mark says, that is what Mark
says. It does say in the review at the introduction to
Ray's Annual Review, page 59: "Unfortunately, you failed
to grasp this challenge and have had in some ways a very
poor six months". I accept that prior to that occasion,
