Day 203 - 12 Jan 96 - Page 17

individual understanding how to complete the audit.

  Q. If there is concern for a particular store, for example,
then finding Fs may be a way of showing to that Manager:
"You have to buck your ideas up and get it together"?
       A. No. I mean, if you go round and it is an F, then
clearly on a full field or occasions such as that, then you
have got a problem which you need to discuss with the
Manager. But I would suggest that if somebody went round
and deliberately gave a restaurant an F and then put it in
front of the restaurant Manager as a suggestion that the
Manager was not performing, then the Manager would quickly
say, "Look, I disagree, because this is not a true
reflection of the store's cleanliness", or whatever the
       audit was on.

  Q. Anyway, just to go back to the grades: there is C plus, is
there not? Is there a C minus?
       A. Yes, by the same token.

  Q. So, below the B grade, there is a C plus, C, C minus and an
       F?
       A. Yes.

  Q. None of those grades, of course, in any aspect of the
store, did Mr. Coton receive in his last full field
       analysis of the stores performance?

MR. JUSTICE BELL: Can you remind me what the date of that was?

MR. MORRIS: It was in the performance review of 1st November,
1990. It is page 63 in that series of his PRs.

  MR. JUSTICE BELL: Thank you.

MR. RAMPTON: My Lord, I am afraid that is not right. At least,
I do not know that it is right. If Mr. Morris means
paragraph 3 at the top of the page, I am not sure that
       I understand it.

MR. JUSTICE BELL: Let me just -----

MR. RAMPTON: Maybe I am wrong.

MR. JUSTICE BELL: I would like to look -----

MR. RAMPTON: No. I think it may be right.

MR. JUSTICE BELL: It may be important if what is being
suggested is that Mr. Coton was, in fact, at least in
1990. So let me just look at it.

MR. RAMPTON: It starts at the bottom of page 4, 62.

MR. JUSTICE BELL: The bottom of the page?

MR. RAMPTON: 62. It is page 4 of the document.

  MR. JUSTICE BELL: Yes.
