Day 203 - 12 Jan 96 - Page 11

would have been a different person, different
       investigation, different circumstances really.

  Q. Can you just give roughly the date, approximate date, that
Mike Buckley was sacked, or the year?

MR. JUSTICE BELL: The mistake is mentioned in a February 1992
       performance review on you ---
       A. I do not believe that this was -- sorry.

  Q. -- which deals with 1991. Does that help at all?
       A. I certainly do not believe that I made any mistakes in
       the actual review.

  Q. I am not asking you about the mistake. We have actually
got no evidence of a mistake with Mike Buckley at the
moment; we have just got a mention that Mr. Atherton
thought you made a mistake in his performance review. But
you are being asked now when Mike Buckley was sacked, if
you can remember. If you can relate it to when you
started, do. If you really cannot remember, just say so.
       A. I am just going to do as you say and just follow the
numbers through and guess that it must have been maybe
       March 1992, something like that.

  Q. March?
       A. 92, maybe. I do not know.

MR. MORRIS: At that time you were Supervisor?
       A. If it was March 92, then yes, I was.

  Q. Before you became Senior Supervisor?
       A. I think so, yes.

  Q. In fact, you were promoted to Senior Supervisor after
receiving this performance review, pretty soon afterwards,
a couple of months afterwards; yes?
       A. Yes.

  Q. Did you witness an incident where, round about 1991 -- I am
just trying to see here -- on a Saturday, where there had
been a blockage above a kitchen ceiling in one of your
stores and the sewage contents from the toilets had come
down into the kitchen area ---

MR. RAMPTON: My Lord, again -----

MR. MORRIS: -- and the store was not closed.

MR. RAMPTON: Mr. Morris really does know now that when his
opponent makes an objection he has to sit down and listen,
however much he may not like doing so.

I really do wonder where we are going now. I make this
observation (which I did not make earlier, but it is right
to make it now), that the Defendants have had Mr. Skehel's
       witness statement since before Christmas.

MS. STEEL: I certainly did not get it before Christmas.
