Day 200 - 12 Dec 95 - Page 06
shot there is the bird that is trying to hobble across the
environment/index.html">litter, and there is also, if you look to the left-hand
side, another bird that cannot stand up in the left-hand
corner at the bottom.

MR. JUSTICE BELL: That is the same one, is it?

THE WITNESS: This is a different one. This is the same one.
That is the same one. This is a different bird. It cannot
stand up. This is a different bird and, if you have a look
in the top right corner as well, you see another bird there
that is clearly dying. This is the start of the whole
film. There are two birds.

MR. MORRIS: This is uncut, is it?

THE WITNESS: This is uncut, this is as it was filmed.

MS. STEEL: Just pause for a moment. I think it might be
helpful if we do the same thing again about them being
different birds because this is the whole continuous thing.

MR. JUSTICE BELL: Will I see the birds which I have seen?

MS. STEEL: Yes, but bear in mind the two things are the same.

MR. JUSTICE BELL: Rather than say "a different bird", let us
see it straight through because I will probably recognise
the shots I have seen already.

MS. STEEL: All right.

MR. JUSTICE BELL: Let it play through.

(The complete video film was shown)

MS. STEEL: The shot that we saw at the end of the building, was
that the outside of the farm that you filmed?
A. Yes, it was.

MR. JUSTICE BELL: Yes.

MS. STEEL: I do not know whether this is remotely important but
just in case it ever is, at the beginning of the continuous
sequence there is no time on the video film. Is that the
same time or what? Can you just explain what happened?
A. I had forgotten to switch it on, but when I realised it
was not on I just pressed the button for the time and date
to appear.

Q. The other thing is I actually forgot to ask you if you are
happy for this statement to be taken as your evidence?
A. Yes.

Q. You have given your estimated age of the chickens in the
middle of the statement. Have you filmed chickens before,
and do you know roughly what age they were?
A. I have filmed chickens before from day one right the
way through to slaughter age.
