Day 198 - 08 Dec 95 - Page 19

  Q. When you were working under Mr. Mark Davis' regime at the
store at Colchester, did crew come to you and say:
"Mr. Davis has been docking my hours"?
       A. Crew would always come and say that there was something
wrong with their hours. I mean, it was an on-going thing.
It would be, someone would actually say they were short of
hours or they had not been paid correctly. I mean, it was
something that would happen every time they got paid, as it
       does in any Company.

  Q. Certainly, people make mistakes, particularly when it is
done manually, about the number of hours that people have
worked, partly often, is it not, because people forget to
clock in or clock off, do they not?
       A. They do, yes.

  Q. They forget to clock out for a break, for example?
       A. Yes.

  Q. You say it was being done systematically in those days just
as it was when you were Manager?
       A. I was trained to do it.

  Q. Have you kept up with Mr. Simon Gibney?
       A. I have only seen him once since I left the Company and
that was a chance meeting that I had in Colchester.

  Q. What prompted you to give evidence in this case?
       A. I was contacted and asked whether I would like to
actually discuss certain things that happened during my
time with the Company and it, sort of, snowballed from
       there.

  Q. May I ask who contacted you?
       A. Mr. Morris.

  Q. Had you spoken to Mr. Simon Gibney at that time?
       A. I had spoken to no-one about this case from the witness
       statements at all.

  Q. Yes, thank you, Mr. Coton.

MS. STEEL: Is it possible to have a 10 minute break so that we
can actually sort out whether we do need to ask certain
       questions?

MR. JUSTICE BELL: Yes. 25 to 12.

                        (Short adjournment)

                  Re-examined by the Defendants

MS. STEEL: When you started as a Security Co-ordinator -- was
       it ---
       A. That is correct, yes.

  Q. -- were you paid the same rate as crew?
       A. It was -- I believe it was a higher rate than crew, yes
        ---
