Day 198 - 08 Dec 95 - Page 09

       it, Mr. Coton?
       A. Yes, I have got it.

  Q. We see old data, true clock in time 10.59, clock out time
13.56. Then when you look at the new data you find that
his clock in time has been pushed -- I do not know whether
it is back forward or forwards -- to 12.59, do you see
       that?
       A. Yes, I have that.

  Q. So he has been deprived of two hours at that end this time,
       has he not?
       A. He has, yes.

  Q. He has lost three hours in all?
       A. It would be three hours.

  Q. Rather than do this exercise with a great number of these
cases, perhaps you would accept from me that 27 people
       appear to have worked on Wednesday, 28th November 1990;
that of those 27 people, 19 were deprived, each of them, of
between one and four hours that they worked -- the man who
lost four hours is Mr. David Lepley, I can tell you that --
and that overall something like 36 and a half hours were
knocked off the clock on that day. Does that not strike
you as a quite appalling state of affairs?
       A. Yes ----

MR. JUSTICE BELL: First of all, you have to be asked whether
you were prepared to accept that that might have happened
       because ---
       A. I have actually said -----

  Q. -- you cannot be expected to check them all now; they can
       be checked -----
       A. I have said in previous statements it was a practice
that was carried out, so I will accept it.

  Q. That would not seem untoward to you?
       A. The amount of hours seems excessive, but I will accept
it otherwise we will be here all day going through it.

MR. RAMPTON: I mean, we can do, we have got all day,
Mr. Coton. I do not want you to -----
       A. I have never disputed that it actually happened, so
I do not feel a problem with accepting it.

  Q. Shall I take another example just so that you can see how
it is done -- I am sure you know -- a simple example? If
you look at the second clock card sheet, you will see on it
in the middle of the page a person, a chap, called David
       Ashley, do you see him?
       A. Yes, I have got him.

  Q. His badge number is 054/1?
       A. It is, yes.

  Q.   He is not far from the top of the list, the Spurgeon list;
he is seven down from the top.
       A. Yes.
