Day 189 - 20 Nov 95 - Page 22

       Rights Commissioner.

  Q. "....I was reinstated." You stand by that statement, with
       that correction?
       A. Yes.

  Q. We have heard already from Mike Mehigan -- Michael
Mehigan -- that there were some concerns about conditions
at the store before the strike started. Did you have any
       concern about conditions?
       A. Well, the wages were extremely low, and also the fact
that the attitude was -- we were all mainly young people
there, or there were some married people there as well who
worked on a part-time basis, some ladies as well. But, in
general, we were very, very young, and we used to just --
I remember, like, working in a freezer for 40 minutes while
a truck was unloaded, and it was absolutely freezing.
There were instances just like that.

You had no -- the overtime rates and that were kind of
geared more towards the fact that you would have to go over
the 40 hours a week before you got any overtime. Say if,
normally, you came in and worked 9.00 till 5.00 and then
you did another two hours; you would never get overtime,
like, for just that day. It always amounted to -- so if
you lost any time during the week, you did not get any
overtime. I do not know if that makes sense?

  Q. Sorry, are you referring to unsocial hours?
       A. Yes, unsocial hours, yes. We worked unsocial hours.
They considered that flexible hours, but for full-time
staff it was really unsociable hours.

  Q. Were you paid extra for working ---
       A. No, you were not.

  Q. -- Sundays, or whatever?
       A. No. You were never paid extra for working Sundays or
       late nights.

  Q. Or late nights?
       A. No.

MR. JUSTICE BELL: How old are you now, Mr. Mrozek?
       A. I am 37. I was 20, going on 20, in April, during the
strike. I was mid-20s. I was 20 when it started.

MR. MORRIS: Were there any concerns about other conditions?
Maybe if we get the -----
       A. Yes.

  Q. One minute. If you can get the document, bundle XIIIB,
pink XIIIB -- it should be behind you -- and open it to
       divider 59?
       A. Yes.

  Q. At the bottom, you have page numbers in the 900s. Can you
       see that?
       A. Yes.
