SIMON JAMES GIBNEY, sworn
Examined by the Defendants

MR. MORRIS: The microphones do not amplify your voice, so you
have to speak slowly and clearly.

THE WITNESS: OK.

MR. JUSTICE BELL: If you want, what I suggest you do is start
standing up, Mr. Gibney, because it is easier to hear
witnesses if they stand up. If at any stage you want to
sit down during your evidence, just pull the chair
forward.

THE WITNESS: Thank you.

MR. MORRIS: Can you give us your full name and address, please,
Mr. Gibney?
A. Simon James Gibney, ****************, **********,
*****, *******.

Q. You say in your statement that you are 25 years old. What
are you now?
A. I am 27.

Q. 27 now. Can you just say what your current position is?
A. I am a self-employed partner in a small transport
company.

Q. That is based in Colchester?
A. That is right.

Q. Just a little bit about what you have been doing since you
left McDonald's. You joined McDonald's in June 1984 as a
16-year-old; is that correct?
A. That is right, yes.

Q. I am going to go into that in a minute. You left in
December 1987?
A. Yes, that is right.

Q. What have you been doing since then; what jobs and what
positions have you done since?
A. A stop gap, I worked in a public house for a short
while before becoming self-employed; mainly waste
collection; and, since 1990, the transport business.

Q. I am going to read out your statement and ask you questions
after that, just to explain certain details and expand a
little bit. Have you got your statement in front of you?
A. I have.

MR. JUSTICE BELL: If you just follow it as Mr. Morris reads
