3 What do you mean by that?
4 A. He was scheduled to work from 4.00 until the close, so
5 he would have come in at around half past 3.00.

9 MS. STEEL: What time did you come into the store and take over?
10 A. I was informed about mid-day that Mike Logan had
11 resigned and so I came in, I looked at the schedule.
12 I wanted to find out if there was another Manager on with
13 him, and when I found out there was not and there was no
14 available cover, I came in and did the shift myself.

16 Q. Mr. Logan said he did go into work that day. He said he
17 came in to run the night shift and found he had been
18 scheduled a completely inadequate number of staff?
19 A. Yes, that is what he says, but I received a message
20 from, a telephone message, from someone called Joe Stapley,
21 and she telephoned me at approximately -----

23 MR. JUSTICE BELL: How do you spell her surname?
24 A. S-T-A-P-L-E-Y. She telephoned me approximately
25 mid-day, which to me indicates that she must have known
26 before mid-day that Mr. Logan was resigning.

28 MS. STEEL: When you came in you never saw Mr. Logan -- when did
29 you come in? You came in at 4.00, did you?
30 A. I came in in mid-afternoon. I came in, sort of, I
31 arrived, I should imagine, about 2 o'clock.

33 Q. You never saw Mr. Logan, is that what you are saying on
34 that day?
35 A. That is correct.

37 Q. The schedule surgeries and the payroll surgeries, those
38 were set up, were they, as a time when crew would be
39 expected to make any comments they had about the payroll
40 schedule?
41 A. That would be right, yes. The idea would be, for
42 instance, with the schedule surgery, if someone had a
43 problem with the following week's schedule they could come
44 along and discuss it then.

46 Q. What time was that surgery held?
47 A. It would vary each week. There was no set time for
48 it. You would try to schedule it at a time when the Admin
49 Assistant was available for at least an hour.

51 Q. Was it generally on a weekday?
52 A. No, it was generally on a Friday night or a Saturday
53 morning or, perhaps, a Saturday afternoon, late Saturday
54 afternoon, because that was when the most people were in.

56 Q. What about the staff who were not on duty?
57 A. They, I mean, if they had a complaint, they could
58 either make it to any one of the Managers or they could
59 phone the restaurant or they could come in and speak, they
60 could send a message.
