Day 168 - 03 Oct 95 - Page 19

MR. MORRIS: So, if you spent two hours checking it, then,
effectively, you would be responsible for anything untoward
that may or may not have happened?
A. No, it is not my job to be responsible for anything
untoward that happened -----

MR. JUSTICE BELL: It is a joint thing, is it not?
A. It is ------

MR. MORRIS: I am establishing what his responsibility is.

MR. JUSTICE BELL: Why make him more responsible than the person
who did it in the first place? They share a
responsibility, on my understanding of what he said.
Between them they hope to get it right. That is his
evidence. You test that, if you wish.

What I would like you to do, Mr. Morris, is put your case
on this, explore, if you wish, as to whether what you
allege could go on without Mr. Richards knowing and, if
that is not possible, put your case to him fair and
square.

MR. MORRIS: I am kind of working through this.
(To the witness): When the schedule was completed it was
put on the notice board for staff?
A. That is right.

Q. You said something about a payroll surgery, would that
include any scheduling?
A. No, you would hold a schedule surgery separate to the
payroll surgery.

Q. How often was the scheduling surgery?
A. Again once a week rather than every two weeks with the
payroll surgery, and that would be held by either myself or
Ian or Geoff.

MR. JUSTICE BELL: Did you say every week?
A. The schedule surgery would be every week. The payroll
surgery would be every two weeks.

Q. Just what happened then; we are on scheduling at the
moment?
A. What would happen was we would post a notice saying
payroll -- the schedule surgery for this week would be at
a specific time, and I would be available for however long
it took, for any queries that people had regarding the
schedule and their hours of work to come to light.

MR. MORRIS: Part of the performance review procedure is that
employees are marked on their attitude, are they not?
A. Not so much their attitude, but there is -- there are
two sections to it. There is a fact based section where
their OCL scores come into it. The other section is a
grade given to them on various attributes by the members of
the management team.

Q. But it includes things like commitment to store progress,
