six or one in seven of our meetings because he did have
       eight restaurants at the time.

MR. MORRIS: When he did attend he had his own personal
       notebook?
       A. Yes.

  Q. Right. The Managers' meetings were quite regular, were
       they?
       A. We held Managers meetings either weekly or fortnightly
depending on when we need to hold them.

  Q. Right. It may help if you have your statement available
just in case I ask -----

MR. JUSTICE BELL: It is yellow X again, please, Mr. Richards.
       Section F, divider 39C.

MR. MORRIS: In your paragraph 6 on page 2 you say you do not
recall instances of employees being allocated shorter or
"unsocial" hours on the understanding that the hours would
improve with their performance. Since 1993 you have never
       done scheduling; is that correct?
       A. I have maybe done the schedule for an odd week. I
would estimate that since at least 1993, 1992, I have
probably done the schedule for five, six weeks, total, and
the only time I have done it is when the scheduling Manager
has been away on holiday or on a course.

  Q. So the people that did it would be delegated by you or
under you there would be other people?
       A. No, there are three First Assistants in the
restaurant. One of the First Assistants generally does the
schedule. When he went on holiday, it would be the job of
the other First Assistant rather than myself to do it
because I had already done it two, three years ago. If
both were unavailable, then I would do it if there was not
a sufficiently experienced other Manager there.

  Q. Just the names of the other First Assistants, say,
concentrating on the last couple of years?
       A. Ian Hendon, H-E-N-D-O-N, and Geoff Rowling.

  Q. Geoff?
       A. R-O-W-L-I-N-G.

  Q. Rowling. So you only have direct knowledge about
scheduling for the five weeks which you did, whenever that
       was?
       A. No, because one of my jobs would be to second check the
       schedule.

  Q. So you were responsible for the scheduling?
       A. No, I would be responsible as to check the schedule,
match the number of allotted hours, match the matrix
hours. It is standard practice to get someone else to
check it to ensure that you do not make a mistake.

  Q. So you checked it overall just to see that the -----
       A. It would be either myself or Phil Cummings each week
