     1   Q.   So you do remember, in fact, when people get results of
     2        their mystery diner surveys?
     3        A.  I remember the occasional mystery diner when, for
     4        instance, it would have been 100 per cent.  I remember that
     5        we have had mystery diners above 93 per cent, but I do not
     6        know whether he actually got 93 per cent, but I do not
     7        remember that specific mystery diner.

     9   Q.   The Bath store, in your view, it was run properly, yes?
    10        A.  I would say so, yes.

    12   Q.   It was a good store?
    13        A.  It is an -----

    15   Q.   Run well?
    16        A.  It is, in my view, a store which at least gets average
    17        grades, if not above average grades, in the criteria set
    18        by  -----

    20   Q.   It does not get above average grades then?
    21        A.  I said it gets ------

    23   MR. JUSTICE BELL:  No, he has just said it is a store which gets
    24        average grades, if not above average grades.

    26   MR. MORRIS:  Would you say it is a better than average
    27        McDonald's store?
    28        A.  I would say that we get the marks that we get, whether
    29        they are Bs or Cs, I do not know.  I have not worked in
    30        that many stores so I cannot comment.

    32   MR. JUSTICE BELL:  I was going to ask how many stores you have
    33        worked in.

    35   MR. MORRIS:  You must be told from higher up whether you are
    36        doing well, or whether you are a poor store, or whether you
    37        are great and you are on course for Store of the Year, and
    38        all this kind of stuff?
    39        A.  We are given targets that are appropriate to the store
    40        we are in.  Whether they are above average or below
    41        average, we are not really told.  We will know if we have
    42        won a specific prize, but other than that we assume that a
    43        B mark would be above average, which I assume would be a C,
    44        but that is just my opinion.

    46   Q.   Right.  Do you generally get round about marks of B?
    47        A.  Well, the mystery diners scores are round about the
    48        Company average, if not again above, and the audit grades
    49        we get are generally above Bs and Cs.

    51   Q.   So, just from your experience, you would say you are 
    52        somewhere slightly above average then? 
    53        A.  No, I am assuming that the average is a C.  I do not
    54        know specifically what the average is.  The only average
    55        I know is that the mystery diner scores, and we are told
    56        what the Company average is every time we get a mystery
    57        diner, and we are given a cumulative grade the same as the
    58        Company is.  The other audits, I am just guessing, you
    59        know, but to me a B grade out of a possible grade of A to F
    60        would assume that we are above average.
