Day 168 - 03 Oct 95 - Page 08
you are to transfer it from another store.

Q. It is, that you should transfer it?
A. In that case, I would assume that it is not illegal.

Q. Which stores would it come from in the case of Bath?
A. Either Chippenham or one of the seven stores in the
Bristol area, so one of those stores.

Q. Yes.

MR. MORRIS: I am just getting some notes down.

MR. JUSTICE BELL: Where shall I put this -- behind Mr. Logan's
statement in the bundle?

MR. MORRIS: Yes, in fact, the list of names should go behind
Logan's statement as well because really that is,
I suppose, the evidence based on what he told me or what I
remember he told me.

MR. JUSTICE BELL: I will ---

MR. MORRIS: That was one I think you temporarily put behind
Mr. Richards' statement yesterday.

MR. JUSTICE BELL: -- put your longhand notes first and then
what you handed up today next. Yes?

Cross-examined by the Defendants, continued

MR. MORRIS: Mr. Logan says in his statement that he got 93 per
cent on a quote "mystery diner" survey which is when
someone from Head Office comes and observes what is going
on without telling the staff that they are there; is that
correct?
A. Not entirely. It is actually an independent Company
that does it.

Q. Right. OK. Is that true, that he got that 93 per cent?
A. I cannot comment either way, I do not know. We have
mystery diners twice a month, so 24 a year. I cannot
actually recall that particular mystery diner, but he may
well have done.

Q. He said he got the highest mark -----

MR. RAMPTON: The witness has already said that he does not
know.

MR. MORRIS: Thank you, Mr. Rampton. (To the witness): Another
question is he said that he got the highest mark the store
had ever gained. Do you remember Mr. Logan getting the
highest mark the store had ever gained?
A. He is incorrect then, as we have had several mystery
diners who was 100 per cent.

Q. Since then?
A. Both since and before then.
