Day 167 - 02 Oct 95 - Page 10

MS. STEEL: The witness accepted it.

MR. JUSTICE BELL: This witness says he does not know about
       them.

MS. STEEL: He accepts that they went into schools. That is
       the important part.

MR. JUSTICE BELL: That may be rather different to setting up
       pretend McDonald's.

MS. STEEL: I think it is actually in their Annual Review, or
something like that. I cannot remember where I read it but
       I read it somewhere.

MR. JUSTICE BELL: What I might suggest is do not ask a question
assuming that something is so, when it is the very first I
have heard it of it and, as it turned out, the witness does
not know that it be so.

MS. STEEL: I thought I was entitled to put anything to the
witness and that if Mr. Tindale does not want to accept it,
       that is up to him

MR. JUSTICE BELL: Quite apart from Mr. Rampton's point, my
point was, you see, you say your question, according to
Caseview: "Being in charge of the well-being, or being a
Chief Training Officer, would that also include, I think
there are some schemes in schools where you get children to
set up pretend McDonald's and get them to run", whatever --
I cannot then follow Caseview there.

We then have the beginning of an answer which was difficult
to relate to your question and the reason for that very
shortly turned out to be that Mr. Tindale did not know
anything about there being a pretend McDonald's. Quite
apart from Mr. Rampton's point, if you had said, have
McDonald's set up ventures where they have pretend
McDonald's in schools, I assume Mr. Tindale would have
said: "Not to my knowledge"; whereas if you start as if it
is accepted that they do -----

MS. STEEL: Actually, he did say he did not at the time which
made it kind of sound as though they do now. I read it --
if it is where I think it was, it was in the Annual Review
       either last year -----

MR. JUSTICE BELL: May be. All I am suggesting is if you want
to go on to something like that, you first ascertain if the
       witness knows anything about it.

MS. STEEL (To the witness): What did your links with
       schools ----

MR. RAMPTON: I am sorry, my Lord, I wish to say, if
       I may -----

MR. JUSTICE BELL: Take your objection forward.
(To the witness): Sit down, please, Ms. Steel.
