Day 167 - 02 Oct 95 - Page 05

MR. MORRIS: No.

MR. JUSTICE BELL: -- you would get it on one side of A4 paper,
would you?

MR. MORRIS: Yes, it would be half a page, I should think.

MR. JUSTICE BELL: I think the best thing is if you do that
now. If you do not mind making some photocopies of what
Mr. Morris writes out, Mr. Riley, to save him doing that.

MR. MORRIS: Yes.

MR. JUSTICE BELL: Then what I suggest is that you hand copies
to Mrs. Brinley-Codd, give me a copy which I will look at
during the mid-day break and then we will start with
Mr. Tindale.

MR. MORRIS: Yes. The other thing is I do not know if the
Plaintiffs have managed to find -- well, have brought to
court the incident report forms that they were ordered to
disclose because, obviously, that will be something we will
be questioning Mr. Richards about. That, if you remember,
was about food, undercooked food.

MR. JUSTICE BELL: What is the position with regard to that,
Mr. Rampton?

MR. RAMPTON: Again I do not want to be difficult, but your
Lordship has not actually made an order. Your Lordship
indicated you were minded to do so. We have asked for
them. Whether Mr. Richards has them here, I will be able
to tell your Lordship in half a second. What happened was
that Mr. Richards put them in the post to Barlow Lyde &
Gilbert on Thursday. They had not arrived when
Mrs. Brinley-Codd's left the office but she will be able to
telephone now.

MR. JUSTICE BELL: Were they the originals which were put in the
post, do you know, or -----

MR. RAMPTON: Yes, my Lord. Apparently, they were the
originals.

MR. JUSTICE BELL: What I suggest is Mr. Tindale is here so we
start with him. Let us carry on with Mr. Tindale. Then
subject to what I said a moment ago about you copying out
-- I am not asking you to copy out your notes because
obviously you may have confidential matters in there -- if
you just copy out enough, perhaps in tabulated form, name
of witness, approximate date, what is suggested happened,
in a fairly bare but, nevertheless, expressive way, so that
they can be looked at -- could you do that in a quarter of
an hour?

MR. MORRIS: Yes.

MR. JUSTICE BELL: I will ask Mr. Dudley to come down at 11.00
and see if you are ready to go then. I would like to hear
