3 MR. JUSTICE BELL: Yes, what do you want to do?

5 MR. MORRIS: Yes. We have an application for leave to appeal
6 being heard this morning ---

8 MR. JUSTICE BELL: Yes, I understand.

10 MR. MORRIS: -- which is not before 12.00.

12 MR. JUSTICE BELL: Yes.

14 MR. MORRIS: Helen at the moment is rushing about trying to copy
15 all the documents which the judges require. It is in front
16 of Lord Justice Kennedy and Sir Roger Parker. I would
17 like, if possible, to have an adjournment. I am applying
18 for an adjournment, certainly until that has been dealt
19 with.

21 MR. JUSTICE BELL: Yes. Subject to anything Mr. Rampton says,
22 there would not be any problem about that were it not for
23 Mrs. Farrer's position. Obviously, I would like to help
24 her if there is any way of doing so.

26 MR. MORRIS: If it is appropriate, then we could complete her at
27 2 o'clock. If we start at 2.00, we will guarantee we will
28 finish by the end of the day.

30 MR. JUSTICE BELL: As I understand it, counsel is helping you in
31 relation to that application for leave to appeal?

33 MR. MORRIS: Yes.

35 MR. JUSTICE BELL: Is Ms. Steel with him now?

37 MR. MORRIS: He is actually on another case, but he is trying to
38 complete that to come back for the application. She is
39 doing things like serving the paper work that the judges
40 require and the administrative matters, basically, paying
41 the fee.

43 MR. JUSTICE BELL: Yes. My attitude is that I should do
44 everything, again subject to what Mr. Rampton says, which
45 enables you to present your application for leave. But, on
46 the other hand, I do not want to sign away time if it is
47 unnecessary to do so. My understanding is that Lord
48 Justice Kennedy and Sir Roger Parker may have been ready to
49 deal with the application before 12 noon, but they have
50 marked it not before 12 noon because the Member of the Bar
51 who is assisting you would not be available until then
52 anyway.

54 MR. MORRIS: That is correct.

56 MR. JUSTICE BELL: What occurs to me is that Ms. Steel, with
57 your help, might get everything filed and ready comfortably
58 before 12.00 and then there is nothing that either of you
59 can do anyway because the barrister who is going to help
60 you is not there. Do you see what I mean?
