Day 159 - 20 Jul 95 - Page 20

fact, the primary findings of fact are the fundamental
findings of fact. The secondary findings of fact are the
facts which you would ask me to infer from the primary
fundamental facts. There is nothing very complicated about
it. They are terms which are familiar to lawyers, in case
they were not familiar to you, that is what I mean.

The primary fact would be: "We invite you to find that A,
B, C, D and E"; the secondary fact would be: "We invite
you to draw the conclusion from A, B, C and D that the
       situation is F". So A, B, C, D and E would be primary
facts and F would be a secondary fact, secondary finding of
       fact.

I am not going to say anything more about that. If you
have any queries about it or anything else you want to ask
me about final speeches before the end of term, choose a
moment to come back to it and if it can be raised at the
same time as any question on privilege, so be it.

MR. MORRIS: That is very helpful.

MR. JUSTICE BELL: Read it through and see what you make of it.
We will adjourn now. What I suggest is that everyone is
available to be return unless there is any difficulty by
       quarter to two.

MR. RAMPTON: Your Lordship is saying quarter to two, not for
the purposes of the witness, as I understand it?

MR. JUSTICE BELL: No, it is because I very much hope I will be
able to give my ruling at that time. Mrs. Farrer is
       still not before 2 o'clock.

MR. RAMPTON: Yes, she has been told that.

                       (Luncheon adjournment)

(Please see separate transcript for Ruling)

MR. JUSTICE BELL: Yes, Mr. Rampton.

                     FLORENCE LUCY FARRER, Sworn
                      Examined by MR. RAMPTON

MR. RAMPTON: Mrs. Farrer, are your full names Florence Lucy
       Farrer?

  Q. Do you give your address as McDonald's headquarters in East
       Finchley in London?
       A. Yes.

       A. I do.

  Q. What is your job that you do for McDonald's?
       A. At the moment I am a customer care person. That means
       I am ----
