Day 159 - 20 Jul 95 - Page 06

issue; it refers to tropical forests.

MR. JUSTICE BELL: You say that means rain forest? That is what
you were arguing yesterday. It is synonymous with
       rain forest.

MR. MORRIS: Tropical forest and rain forest, there is no clear
demarcation. My reasonable belief, based upon discussions
with our expert and the discussion I had this morning, is
that the Mato Grosso includes areas which could be defined
specifically as rain forest, but the area of concern which
our witnesses are concerned with, and including Mr. Shane
in his map -- if you want to check it later or you could
check it now if you want to, his map on page 5 of his book
-- defines the area of concern of tropical forest, which
all his evidence is based on, as being the whole Amazon
region. We did look at it yesterday.

MR. JUSTICE BELL: I must say I do think you have gone a bit off
the track now because you spent quite a lot of time
yesterday succeeding in convincing me that when Mr. Shane
used the word "tropical forest" it was the same as
"rain forest". I had understood the whole of your Brazil
amendment 1 to be referable to rain forest. Now we seem to
be bringing in something which might or might not come
under the general forest recycling and waste aspect with
regard to cerrado forest. No-one suggested any of the
cerrado forest is used for paper making.

MR. MORRIS: No, the whole recycling waste issue is absolutely
nothing to do with Brazil whatsoever, but the area of
       concern -----

MR. JUSTICE BELL: That is the only way non-rain forest forest
comes in, does it not, under recycling?

MR. MORRIS: No, because, with respect, the leaflet in its
introductory paragraph refers to tropical forests and when
       people -----

MR. JUSTICE BELL: You want to unpersuade me now that that is
       just rain forest, do you?

MR. MORRIS: The whole of the Amazon region -- I think this
could be a bit like the debate on styrofoam and polystyrene
foam, that styrofoam is how the public understand what
polystyrene foam is, but polystyrene foam is the specific,
you know, defined, correct technical term.

It is the same with rain forest; the public understand
rain forest in terms of Brazil as the whole Amazon region.
The whole Amazon region which -----

MR. JUSTICE BELL: I do, with respect, think you have slightly
       gone off your track.  I can see you might -- I do not know;
we will wait and see -- if you want to rely on Mr. Monbiot
when we come to soya, in so far as we do come to soya, but
you are not addressing me on possible amendments 3 and 4 at
       the moment.
