12 MR. MORRIS: It is the International Product Specification.
13 Yes. It is actually volume VIII, pink VIII, sorry. The
14 specifications are in both, but the International
15 Specification is in volume VIII. It is the one with the
16 International Specification.

18 MR. JUSTICE BELL: It is actually in pink VIII, but it was
19 inserted at the front so it may be that it is listed as a
20 bundle of copy relevant extracts from the Plaintiffs' Meat
21 and Poultry, Food Product Specification. Is that what you
22 have in mind?

24 MR. MORRIS: Yes. The trouble is that particular one -- it was
25 put in at a later date -- has not got the International
26 Specification which we have found now in volume IX in the
27 middle of the General Product Specification. It is tab 2,
28 volume IX, page 22. It is page 22 in that bundle. It is
29 point 9 on that page. This is the International Product
30 Specification Addendum. It is for their meat patties
31 internationally.

33 In point 9 -- this is dated October 3rd 1989 which, of
34 course, is a more relevant time period -- it
35 says: "Imported beef to be used only when approved by the
36 Country Purchasing Manager and documented in a
37 specification addendum." Therefore, if this is (as has
38 been claimed) a compulsory specification on all McDonald's
39 sections internationally, then every case of imported beef
40 will be documented in a specification addendum. It will be
41 a simple matter for each country to check the countries
42 from which they have had imported beef.

44 MR. JUSTICE BELL: I understand that in relation to the question
45 whether it should be UK only or other countries in relation
46 to No. 2, was it not?

48 MR. MORRIS: I would suggest that, certainly with relation to
49 Brazil, that information should be made available.

51 MR. JUSTICE BELL: Hold on a moment because I was going to ask
52 you about that. Your case in relation to Brazil is not
53 importation at all, is it? It is quite the reverse.

57 MR. JUSTICE BELL: You mount amendment No. 1 in part upon the
58 basis that in the 50 stores they had by 1989 they would be
59 using Brazilian beef, and I follow that.
