Day 154 - 13 Jul 95 - Page 14

  Q. If people have a disagreement about what they are being
told to do, would you encourage them to not do it, walk off
their shift, or say: "I am not doing it", go on strike?
       A. Would I encourage my crew to go on strike? I do not
       think I would, no.

  Q. If they felt aggrieved by something?
       A. That is a very hypothetical question, but I cannot
imagine the circumstances where I would encourage the staff
       to go on strike, no.

  Q. Why is that?

MR. JUSTICE BELL: No. I am sorry. You have gone far enough on
this. In relation to Colchester, whatever may be said of
certain other compartments of the case, you have an
abundance of evidence which you are going to call. The
weight to be attached to it I will have to assess when
I have heard all the witnesses. We do not have to go off
       at a tangent like this.

MR. MORRIS: The situation is, is it not, Mr. Davis, that you
did not want anything like McDonald's Freedom Fighters or
people getting together and walking off shifts after a
disagreement with managers, because you do not want the
workers in your control, under your control, to have any
kind of collective organisation to stand up for themselves,
       do you?
       A. I would not want workers to be walking out of a shift
       on a regular basis.

  Q. You do not want workers under your control to have any kind
of independent collective organisation to stand up for
       themselves, do you?
       A. There are plenty of methods by which they can voice any
       grievances within a restaurant.

  Q. They can come to you?
       A. They can come to me. They can follow the grievance
procedure. There are plenty of outlets for them if they
have a problem within a restaurant.

  Q. Go to a crew meeting?
       A. They can do that in ones, twos, threes, fours -- in any
number, as far as I am concerned.

  Q. None of those involve collective organisation of the staff,
       do they?
       A. If they want to come in in groups of more than one or
two, I do not see a problem.

  Q. To come and see you?
       A. Certainly, yes.

  Q. But crew meetings always have management present, do they
not, and so do rap sessions?
       A. Well, the rap sessions would have somebody who was not
       connected ---
