     1   Q.   What action would you take against the management upsetting
     2        the staff, then, upsetting the people that do the work in
     3        the store?
     4        A.  I did not say that the management upset the staff.

     6   Q.   Who did disciplinary action would you -----

     8   MR. JUSTICE BELL:  Do not answer that question, because it is
     9        entirely hypothetical.  If we hear evidence about it -- if
    10        it is put to you that the shift manager had done this or
    11        that specifically, then you can be asked what steps you
    12        would have taken.

    14   MR. MORRIS:  So the situation is, Mr. Davis, if there is
    15        disagreement that would lead to staff taking some kind of
    16        action, you would automatically threaten some kind of
    17        disciplinary action against the staff, not the manager?

    19   MR. RAMPTON:  My Lord, it is that difficult word "so" again.
    20        I honestly do not think that follows from -----

    22   MR. MORRIS:  Forget the word "so".
    23        A.  I would take each individual situation as it occurred.
    24        You would have to look at the ins and outs of all
    25        situations.  If the management were in the wrong, then
    26        obviously I would have to speak with them as well.

    28   Q.   How many managers, shift running managers, have you
    29        disciplined for upsetting staff?  Give us some examples of
    30        discipline you have taken against shift running managers
    31        for causing staff to be unhappy, for whatever reason; give
    32        us an example?
    33        A.  I cannot recall any examples specifically.

    35   Q.   So there are numerous examples, are there?

    37   MR. JUSTICE BELL:  No.  I am sorry, Mr. Morris.

    40        A.  I may be able to dredge a couple up.

    43        A.  I cannot remember any.

    45   MR. JUSTICE BELL:  No.  Please do not dredge a couple up.  Of
    46        all the stuff which has floated to the surface of its own
    47        account in this case, which is quite enough to cope with,
    48        we do not need to go dredging.  If you can remember
    49        something here and now which helps Mr. Morris, do so, but
    50        do not go dredging.

    52   MR. MORRIS:  Crew members do have disagreements with managers, 
    53        do they not, from time to time?
    54        A.  Occasionally, yes.

    56   Q.   They all just happily accept everything they are told?
    57        A.  No.

    60        A.  Yes, occasionally, yes.
