     2   MR. JUSTICE BELL:  No.  I am sorry, you are going too quickly
     3        for me.  (To the witness)  I had not understood -- tell me
     4        if I am wrong -- that the walking off the shift actually
     5        provoked a comment about saying there would be trouble.
     6        For a start, you cannot even remember saying there would be
     7        trouble.  All you are prepared to accept is that you might
     8        have said that.  Am I wrong about that?
     9        A.  No.  You are right, sir.

    11   Q.   So you are not accepting you said that there would be
    12        trouble after they walked off the shift?
    13        A.  No, I am not, sir, no.

    15   MR. MORRIS:  You did say that if people walk off shift --
    16        I cannot remember exactly what you said, but from my -----

    18   MR. JUSTICE BELL:  That is common ground.  You seem to be
    19        asserting that he did say there would be trouble to them
    20        after they walked off shift; and I was merely clearing my
    21        own mind that he had not accepted that that was so.

    23   MR. MORRIS:  OK, but the statement seems to imply that, the
    24        sworn statement you made.  It is not sworn?  It is signed,
    25        anyway.

    27   MR. JUSTICE BELL:  All he says is it is possible he said
    28        something similar to "there would be trouble".

    30   MR. MORRIS:  It is now 18 months on from when you wrote your
    31        statement, is it not?
    32        A.  Yes.

    34   Q.   So when you wrote your statement, you would not have put
    35        anything in that was untrue?
    36        A.  No, I would not.

    38   Q.   Why would people walking off the shift following a
    39        disagreement with a shift running manager lead you to no
    40        choice but to take disciplinary action?
    41        A.  I did not say there was no choice but to take
    42        disciplinary action.

    44   MR. JUSTICE BELL:  He did not say walking off shift was.  You
    45        may go on to make the same point, but he said if they kept
    46        walking off shifts, did he not?

    48   MR. MORRIS:  If people kept having a disagreement with the shift
    49        running manager and kept walking off shifts, why would you
    50        have no choice but to take disciplinary action against --- 
    51        A.  If I said no choice -----

    54        A.  You would have to take the individual incidents.  We
    55        are talking hypothetically here because, as I remember,
    56        people did not keep walking off shift.  But should the
    57        incidences have occurred where people just walked off
    58        shift, then obviously you could not just allow that
    59        because, obviously, you need them there to work.
